In Oregon anyways. A judge finally did the right thing and said your camera can't be taken without a warrant.


"But it was Solesbee's next act that sent legal minds across Oregon into hyperdrive: He seized the environmentalist's video camera without a warrant.

That's the electronic equivalent of police walking off with several file cabinets of private papers without benefit of a judge's signature, said Lauren Regan, Schlossberg's lawyer.

U.S. Magistrate Judge Thomas Coffin ruled in a pretrial hearing in the Eugene case that Solesbee violated Schlossberg's Fourth Amendment rights by searching the contents of his camera without a warrant. That ruling marked the first time that a federal court in Oregon weighed in on warrantless seizures of digital devices.

"Across the country right now, legal scholars and lawyers are just eating it up," Regan said of the ruling, "because it's actually a solid statement of the right to privacy in the age of technology."

Tell the revenuers to fuck off (yes use that exact language ), when they try to take your camera as evidence without a warrant.

This needs to play out, but hopefully the Communists of America don't win this one as they have so many times in the recent past.

Can't they still take it for other reasons they deem "appropriate" however? Like, if you are recording at a time they think is unsafe for the officers? or some spazz.. I've heard worse.

Good on OR lawmakers tho. about time the lunatics in there stop wielding machetes to get their point across on the floor.

They can always ask, but you can always deny. If you had it on while you were doing something stupid, I would suggest turning it off before they walk up to you, otherwise it would be like opening the door to your house and a smoke cloud of burnt weed hits them in the face. In other words if they saw it turned on, they might use that against you. (probable cause)

The bottom line is we live in a police state. Some tend to do what ever they want and the court sorts it out later. Most cops are good honest guys, a few you run into every now and then, are lieing POS. (Just like people at any other job)

so they seize the camera and just don't look at it until they get a warrant signed, you're still going to be fucked! it's just delayed, slightly, like somehow they can seize your vehicle for "investigative purposes" and apply for a warrant to search it while they have your car locked up at the impound (charging you for storage too)!

This is useless....

Do magnets erase flash storage? If I were doing something illegal, I'd keep a magnet somewhere on my bike, just a small, powerful one would do the trick I assume.
