| Shredder | OP, glad your OK. It sounds like this was definitely your first time on FS-90/23 (back road to Trout Lake/Klickitat). If this was the case and you hit the dip that I suspect, I can tell you that it has been there for at least the last three years (if not longer, and no, it wasn't marked before). Because it wasn't marked and is typically hard to spot (sits in a almost perpetually shady spot), it has always seemed to catch most riders unaware. Your encounter would be the first actual crash that I've heard of concerning that dip, but I'm willing to bet that your not the only one. That sucker kicked me in the cahookies to the point of tears and screaming for an ice pack when I first encountered it. I'm certainly not an attorney, but in regards to a lawsuit (and this has been touched upon already), an argument that might be used against you is that the gov't was aware of the damage to the road and set the speed limit accordingly. I'd be very surprised if they didn't use this as a basis to argue you were 'obviously' riding faster than the conditions allowed, and thus they should not be held liable for your 'bad' decision. Of course the only person who can say you have a case or not is an actual attorney (and at least one member, who is an attorney, has already chimed in). |

BAATGATT See you had ATGATT All the gear all the time and you lived good for you. You however forgot the BA at the beginning of ATGATT which stands for BRAINS AND ALL the gear all the time. If you had remebered your brain you would not have wrecked. Sue yourself then use the money to get an education. |

Sport bike riders are the lowest of the low given the media attention we tend to get. Our sport bike riding OP was railing through the twisties at a speed well in excess of his skill given the road conditions, but he shouldn't have to pay for his own mistake. Instead, the tax paying public (the suit would be against the State) should foot the bill for this one. Good luck with that argument. OP, I'm glad you're ok and I know you've taken more than a little grief from your post. Unfortunately, you put the question out there. Lest, you think that I'm bashing you unfairly, I will admit that almost the exact same thing happened to me a few years back. I hit an awfully deep dip at the apex of a tight corner which threw me off of my line and off into a muddy ditch. True, the road conditions were less than ideal, but it was ultimately my lack of skill that caused the crash. Rather than fret about a ridiculous claim, I expended my energy in improving that technique so when I encountered a similar emergency in the future, it would be a non-event. |

It's a forest service back road that's not even paved the entire way. It's not a highway. And it's definitely not a road you mess with or you can get hurt. Lots of blind curves, shadows, obstacles (with new one's appearing every winter), unpaved sections. To make it more interesting, if you go down very little traffic and a long ways from an ambulance. Even better, the ambulance that comes is likely to be some four corners first responder that never sees any action and has no idea what to do for you except sit there trembling while you wait for real EMTs to show up. I think you would enjoy the roads down there, but if I took you I think your opinion in this case would change. | |
