I Ride: 2008 Ducati 1098
highsided the Duc.....lawsuit??
Went for a sweet ride with a couple guys I met in the forumns (kewl guys by the way). Ended up highsiding the duc due to a horribly bad road. Dont remember any of the crash at all but Im told that I hit a pretty bad sink trench in the road which caused the front end to compress and bottom out resulting in a highside crash.


Looking for some advice here. I would think that due to the condition of the road there would have been some warning signs stating something to the effect of "motorcycles use extreme caution". My brother and son went out the next day to pick the bike up from the Carson impound lot and they said that a sign had been placed. I'm thinking a lawyer might be in order on this one.....????

No. If the road is that shitty, go slower.

Glad you're OK though. Highsides don't have a high "I walked away from that" rate.

Sorry to hear about your crash. Hope you heal up. With that's said:

You crashed, it's you're responsibility. You accept the risk of riding; and sometimes crashing. That's why you carry insurance on you.

It's not the counties responsibility to keep you safe; that's your job. You clearly exceeded the traction available. That's the risk of the road. Can't say I could morally blame anyone but myself for this if it were me.

If you want pristine corners, hit the track.

Anyway, hope you and the bike at back at it soon.

For a minute I thought you were on a logging road until I saw the stripes.

I'd kick my self in the ass for not going slower on that shitty road. As for Suing someone, man up to the fact you were going faster than the speed limit on a shitty road.

Your obviously not in a coma or typing with two broken arms.

I'm not an attorney so can't help with the lawsuit question. Bike totalled?

Really OP? I'm trying pretty hard not to go on a long rant here, but take some responsibility for your actions. You mention having a son, so I would assume you are over the age of 18. Placing blame on others is something a child would do in this situation, don't be a child

Crashing is no fun for anyone and I hope you heal fast. I had an incident last year and someone up there got it on film. After much thought and continuing to blame poor road conditions I realized it was me that caused it. Half a dozen other riders went through the same spot without a hitch and I was the only one that ate it? I was going too fast for conditions and paid the price. It may be a different story if the patch of road caused everyone to wipe out but unless there is evidence of this we are on our own. Get healed, get the bike rolling and get back in the saddle. I try to learn from my mistakes and others and trust me, I've made many and plan on a few more before the year is up!

I've heard it and read it many times:

"wisdom comes from experience experience comes from mistakes"

Yeah, had you actually been riding withing the limits (you + road), this wouldn't have happened.


Sometimes it pays to 'scout' a road before you rail it.
