Anthony Miller Hit, Killed Daniel Baldwin In March

PORTLAND, Ore. -- A man who hit and killed a local musician while driving drunk was sentenced to a year in prison and three years of probation Monday.

In March, 32-year-old Anthony Miller hit and killed Daniel Baldwin near Southeast 21st Avenue and Powell Boulevard.

Baldwin was on his motorcycle and died at the scene. He was a musician and active in the motorcycle community.

One of Baldwin's friends spoke at the sentencing.

"Dan's absence in our lives will leave a gap of epic proportions. He was a best friend to many of us. We will always remember his radiant charm and energy and positive approach to his adventures and misadventures of life. Our lives will go on without him but they will never be the same," said Kelly Ellerbroek.

I think he should have to spend the rest of his life making financial restitution.
He and all like him who drive like this and kill/ injure someone.

That would likely be done in Civil Court.

agreed 1yr is pretty bs. slap on the wrist... at the minimum take his license for good, ban him from operating any motor vehicle.

two principles here - ex-post and one ex-ante. ex-post, the crime has already happened so moving forward is it a good use of society's dollars to stick him in prison with hardened criminals, etc. when we could be funding other things like schools and infrastructure.. at the same time to make this type of thing not worth the risk, i.e. drunk driving, (deterrent principle) they should make the punishment extremely severe like 20Y prison time. by the time he gets out he will be out of the prime of his life IMO.

Killing someone while driving drunk should be equivalent to murder!

No amount of prison time will justify one's death but a 1 yr sentence is tragic!

I considered "Hippie Dan" a friend. He was a great guy, all around. He's greatly missed by a lot of people, and his loss left a HUGE hole in the Flying 15 MC's clubhouse...

He is missed.

And now I am just PISSED. So I guess it's okay to drive drunk and kill someone these days, huh? A YEAR? Wow. Good lawyer, crappy justice system.

Alaska Region, July 12, 2007

After nearly two years of investigation and negotiations, the Kenai District Court for the State of Alaska has accepted plea agreements from three defendants stemming from the taking of moose illegally in a remote area of Kenai National Wildlife Refuge. The 2005 case was developed from eye-witness reports from other hunters. Charges were filed against a local man, a juvenile resident, and a non-resident hunter from Oregon that included taking three moose in a closed season, possessing/transporting illegally taken game, and falsifying a permit report. Additional charges were made, after the initial investigation, for illegally providing big game transport services during a separate hunt to a non-resident hunter from Arizona. The settlement agreement included a total of $20,500 in fines ($13,500 suspended), 810 days in jail, 160 hours of community service, loss of hunting privileges within the State for one year, prohibition of hunting in the Refuge for 3 to 5 years, and loss of firearms, moose, and trophies.

I second that. For killing somebody under the influence.. you should never be able to drive again. If he got really drunk, went up, and shot this motorcyclist, he would of gotten worse. why should driving be any different?

Why not just hanging in Walla Walla...that should be a pretty good deterrent and much cheaper than paying a Comcast bill for 20 years.

Manslaughter should be manslaughter (accidental murder).

Shouldnt matter if your drunk or just f***ing stupid, to kill on accident is to kill on accident. The penalty should be the same.

Problem is they act like its ok to kill a motorcyclist.

But now if you kill somebody who's jogging, or kill somebody in a car while your drunk or high and OH S***, you get 6-8-10 years. But this was just a motorcyclist, so it's ok... probation will do.

...but only if they're on a MOTORCYCLE.

If their jogging, riding a bicycle, walking or driving another car then you're fu****.

But if they're on a motorcycle, it's mostly their fault anyhow, so that's different.

So make sure when you do it, they're a fellow rider, then your ok.

so if youre a hit man you could theoretically just wait for your victim to get on a motorcycle then get drunk and run him over and only have to face 1 year in prison, if that...instead of stabbing him to death or shooting him in the face...which is much worse somehow than running someone over


fucking piece of shit judge, he should be run over and his murderer should only get a week in jail and community service
