I think if I was you, I would call the Beaverton city prosecutor and ask why, with all the witness statements and the fact he hit you from behind this guy has not been charged.

Road rage.
Attempted vehicular manslaughter.
Reckless driving.

These are all valid charges this dude should be facing.
Remember to not admit to any poor riding on your part.

I have to agree with Jeffytune, there seems to be a breakdown here. At the least I think this need to be looked into a little further. The insurance is going to weigh heavier on the officer than the witnesses, and you WILL pay the price for his biased decision.

Yeah I'd definitely try and follow-up on anything that can be done to get this guy prosecuted. If he was stopped behind you at a light, then rear ended you when it turned green, AND you have multiple eyewitnesses willing to back that claim up, then I don't see how the claim that you cut him off holds any water. Especially if the officer wasn't even there at the time.

I'd say to lawyer up, but it sounds like you've already done that. I'm not sure what suing him yourself entails, but the city ought to be doing this. Might not hurt to get a second opinion from another lawyer.

I'll have to keep an eye out for this guy... That's only a few blocks from where I work, and I usually take the bike...

This is true. Hopefully there is at least a report stating he hit you from the rear. Luckily in Oregon state, he is at fault regardles of what happened in front of him.

I've had something similar happen!! BUT the whole manslaughter, homicide things - GO WITH IT!!!

Get this guy! Teach him a lesson... News maybe? TONS of pics of bike taken?? document EVERYTHING!

have a fight with your wife, kick your dog, stub your toe!!! blame it all on this guy!

just DAMN!

even IF you did cut him off - so the hell what??? attempted murder with a deadly weapon -there is NO question about that if there is witnesses!! hopefully you got their info too!!

I'm back in action! Guy did $3000 worth only damage but they didn't total my bike out. Collected check got all the parts and fixed it. No word back from the police sargent yet so I'm going to call him tonight and see what's up. Thanks for all the support and help! This guy will get his in the end.
