I got in a car accident that was clearly not my fault. The other driver and i hit on the front. We moved the cars out of the way as it was still driveable so as not to impede traffic. When i explained the situation to the cop when he arrived he stated I CANT WRITE A CITATION because i was not there to see the accident. Yet when it comes to motorcycles they give em out like candies? Something is not right here. ![]() |

They let the insurance companies figure out who's at fault. In a single vehicle crash they almos always cite. They assume it was your fault... |

I'm also curious about all the "high and mighty" comments about what gear he was or wasn't wearing. Last time I checked legally the only thing he has to wear in Oregon is his helmet. If he want's to ride in shorts and a t-shirt then so be it. Where do you get off talking shit to him because you like to wear every piece of gear you can? He isn't going to hurt anyone but himself. Shit is irritating that every time someone says that they were riding in something other than a one piece kangaroo leather suit, you "holier than thou" fucks get on here and bash people for it. | Newbie Joined: Apr 2011 From: Monmouth, OR I Ride: GSX-R 600 K7 | The outcome! So i decided to fight the ticket myself in Municiple court. What a joke that it. Officer didn't not swear in for my case, nothing was recorded, he had no witnesses show up and his "testimony" was inconsistent with what he filed on his police report. I was found GUILTY!?!?! The judges reason was based on "circumstantial evidence." Basically even though the officer didn't witness the incident it "could have been speed racing" therefore i am guilty. I requested paper work to file an appeal. After leaving that court before going absolutely nuts, i came home and immediately called a lawyer, Kevin Swanson, who was highly recommended to me by midvalleybiker. Kevin and I had trial this morning. The citing police officer (1 of 2 at the scene) and the one witness showed up. They were both questioned. Before being called to the stand to give testimony, we motioned for a dismissal from the judge and it was GRANTED!!!!!!! The judge said that there was no evidence of Speed racing ORS 811.125 and that it would have been easier to get a careless driving to stick. What did i learn from this much needed experience? - Take as many pictures as you can - Do not talk to police officers - Municiple Court is an absolute joke - Most importantly, listen to your fellow bikers on PNWriders and Get a lawyer! It cost me a lot more money than it should have because i decided to research and fight my case solo. |

| Newbie Joined: Apr 2011 From: Monmouth, OR I Ride: GSX-R 600 K7 | Winning this case meant for me that a) I don't have to pay a ridiculous insurance quote for my next bike b) I don't have to pay higher rates on my car c) It does not go on my record d) I don't have to pay the $600.00 fine (though the appeal + lawyer initially costs more, but i was thinking about long term affects) e) My license does not get suspened f) I just love winning! |

(experience being spoken hear), yes it'll cost you allot more time at the side of the road.... but you'll be saved from having to go back to court for more BS.
